Agreed Statement Following Consent Orders

On 15 May 2025, the Court ordered the plaintiff to pay security for costs of $628,882.50. The plaintiff applied to appeal the order to the Court of Appeal but on 12 May 2026 that application was declined. The plaintiff has not complied with the order to pay security for costs, so the defendant has made an application to the Court to stay the proceeding until the security is paid and the plaintiff has consented to that application. If the plaintiff does not pay the security by 1 September 2026, the defendant can apply to the Court to dismiss the case.
